Thank you for utilizing our Services, provided to you by Nobium ("Nobium" or "we").

These terms of service (the "Terms") are effective as of May 25, 2023, and shall remain in effect until modified or terminated.

Your utilization of our Services implies your acceptance of these Terms. We advise you to review them thoroughly.

1. General

  • 1.1

    These Terms of Use ("Terms") are applicable to all Customers accessing our Services through the Nobium’s website or other means. These Terms govern your use of the Services, the website, and all transactions and business interactions between you and the Nobium.

  • 1.2

    By selecting the relevant checkbox during the Sign-Up Process or while completing a Transaction through the Nobium, you agree to: I. be bound by these Terms and to use our Services solely in a lawful manner and in good faith in accordance with these Terms. II. adhere to the Nobium’s Anti-Money Laundering (AML) Policy and Privacy Policy by providing explicit consent on the website.

  • 1.3

    The Nobium reserves the right to modify these Terms at any time at its sole discretion. Continued use of the Services following any amendment constitutes your acceptance of the updated Terms.

  • 1.4

    Unless expressly agreed to in writing, the Nobium does not recognize any terms and conditions other than these Terms in relation to any Customer or Customer Relationship.

  • 1.5

    By accepting these Terms, you consent to receive electronic communications from the Nobium. Such communications may include information regarding your Account, Transaction details, notices, and other information pertinent to our provision of Services.

  • 1.6

    Upon signing up for our Services, you may be required to provide additional information about yourself, as well as submit documents in accordance with our AML framework. We appreciate your understanding of this process.

  • 1.7

    1.7 Different criteria may apply for Natural Person Customers and Corporate Customers, particularly regarding the documentation necessary to establish a Customer Relationship and conduct Occasional Transactions.

  • 1.8

    In certain jurisdictions, the use of cryptocurrencies may be prohibited. It is your responsibility to understand the regulatory requirements in your jurisdiction concerning bitcoin transactions prior to using the Services.

  • 1.9

    A "Business Day" is defined in this Agreement as any day other than Saturday, Sunday, or a public holiday when banks are open for business.

DISCLAIMER: Trading or holding Bitcoin or any other cryptocurrency involves a high risk of loss. You should carefully evaluate whether trading or owning Bitcoin or any other cryptocurrency is suitable for you based on your financial situation. Please be aware that the price or value of Bitcoin or any other cryptocurrency may fluctuate rapidly, decrease, and potentially collapse to zero.

2. Eligibility

  • 2.1

    These Terms of Use ("Terms") are applicable to all Customers accessing our Services through the Nobium’s website or other channels. These Terms govern your use of the Services, the website, and all transactions and business interactions between you and the Nobium.

To be eligible to use the Services, you must: I. be at least 18 years of age; II. be either an individual or a duly authorized representative of a legal entity with the legal capacity to enter into these Terms (representatives acting on behalf of Natural Person Customers are not permitted); III. not have been previously suspended or banned from using the Nobium’s Services; IV. not be classified as a Politically Exposed Person (PEP), nor be a Relative or Close Associate of a PEP; V. not be subject to any sanctions list; and VI. not possess an existing Account.

3. Risk Factors

  • 3.1

    Cryptocurrency assets are subject to significant market risks and volatility.

  • 3.2

    By accessing this User Agreement or utilizing the Services, you acknowledge and accept the risks associated with the use of Virtual Currencies, which include, but are not limited to, risks related to hardware, software, and internet connectivity failures, the risk of not achieving a certain market value or price for any crypto asset, the risk of malicious software intrusion, and the risk of unauthorized access to information stored by third parties.

  • 3.3

    You acknowledge that the Nobium shall not be liable for any communication failures, disruptions, errors, distortions, or delays that may occur while using the Services.

  • 3.4

    The potential for loss while using Services involving crypto assets is significant, and losses may occur rapidly. Prices and liquidity of crypto assets can fluctuate dramatically; past performance is not indicative of future results, and you assume full responsibility for your actions.

  • 3.5

    You acknowledge that the Nobium is not liable for any damages resulting from your investments. The Nobium does not arrange or provide trading, investment, or brokerage accounts or facilities, nor does it offer investment or financial advice.

4. Registration and Verification

  • 4.1

    To utilize the Nobium’s services, you are required to register, create an account, and complete identification and verification as detailed herein.

  • 4.2

    The information requested may include personal details such as your name, address, telephone number, email address, date of birth, taxpayer identification number, government identification number, bank account information (including bank name, account type, routing number, and account number), network status, customer type, customer role, billing type, mobile device identifiers (IMSI and IMEI), and other subscriber status details. By providing this information, you affirm that it is accurate and agree to update the Nobium should any information change. This information will be handled in accordance with the data protection provisions outlined in this agreement.

  • 4.3

    In compliance with applicable anti-money laundering and counter-terrorism financing legislation, the Nobium is obligated to report any suspicions of money laundering or terrorism financing to the appropriate authorities. The Nobium is prohibited from disclosing to any Customer the existence of such suspicions.

  • 4.4

    By accepting these Terms, you represent that all information provided is complete, true, and accurate. You agree to promptly update any information provided to the Nobium to ensure it remains complete and accurate at all times.

  • 4.5

    You authorize the Nobium to conduct inquiries, either directly or through third parties, as deemed necessary to verify your identity and to protect against fraud or other financial crimes. You acknowledge that your personal information may be shared with credit reference agencies, fraud prevention agencies, or financial crime authorities, who may respond fully to our inquiries. This identity verification process should not negatively impact your credit rating. Additionally, you may be required to wait a specified period following a transaction before being permitted to access further Nobium Services or engage in transactions exceeding designated volume limits.

  • 4.6

    Failure to provide any information that the Nobium reasonably requests in accordance with applicable anti-money laundering laws and regulations may result in the suspension of Services to you (including access to your account) and/or the termination of this Agreement. The nature and scope of information required may vary depending on the Services rendered to you under this Agreement and/or your selected payment method.

5. Service Restrictions and Restricted Use

  • 5.1

    The Nobium’s website and Services are not intended for individuals who are prohibited from accessing or using such websites and Services under the laws of their citizenship, domicile, or residency. Individuals who are not permitted to access this website, or who are uncertain about their eligibility to use the Nobium’s Services, are advised to exit the website.

  • 5.2

    In accordance with relevant legislation and our AML framework, we do not provide Services to individuals on any sanctions lists, or to those classified as PEPs, Relatives of PEPs, or Close Associates of PEPs. Users with concealed or protected identities will not be served by the Nobium.

  • 5.3

    Customers who have changed their name or gender must provide documentation confirming such changes.

  • 5.4

    As a Customer, you agree to comply with all applicable legislation, these Terms, and any other guidelines or rules issued by the Nobium regarding the Services.

  • 5.5

    Any use of the Services for illegal or unlawful purposes is strictly prohibited, including but not limited to, facilitating: I. money laundering, terrorist financing, or financing of weapons; II. human trafficking; III. the distribution, offering, or promotion of goods or services that violate intellectual property rights or other third-party rights; IV. access to controlled substances; V. illegal gambling services or the laundering of proceeds derived from them; VI. content that violates protections for minors or is otherwise detrimental to minors; VII. trading in endangered species; VIII. unauthorized purchases or sales of products, technology, services, or other transactions with third parties, including fund transfers; IX. any other activities in violation of applicable law.

  • 5.6

    Your use of our Services must not infringe upon public interests, ethics, or the legitimate rights of others, including actions that disrupt or impede the ability of other Customers to utilize the Services.

  • 5.7

    The use of any “deep link,” “page-scrape,” “robot,” “spider,” or any automatic device, program, script, algorithm, or process to access, acquire, copy, or monitor any part of the Nobium’s properties or to reproduce or circumvent the functionality of the Services in order to obtain any materials or information not intentionally made available through the Services is strictly prohibited.

  • 5.8

    You are prohibited from taking any actions that impose an unreasonable or disproportionately large load on the infrastructure of the Services or the Nobium’s systems or networks, or on any systems or networks connected to the Services, or from using any device, software, or routine to interfere with the proper functioning of the Services or with the use of the Services by any other person.

  • 5.9

    You may not impersonate another individual, manipulate identifiers, or employ social engineering tactics to conceal the identity or origin of any communication or transmission directed to the Services.

  • 5.10

    In the event of prohibited use of the Services, the Nobium reserves the right to take action, including the cancellation or suspension of your account or transactions. In the case of a material breach of these Terms, legal action may be pursued.

  • 5.11

    The Nobium may disclose anonymized information regarding alleged violations of these Terms and any actions taken on our website or other Nobiums, to the extent permitted by law.

6. Breach of Terms and Termination by the Nobium

  • 6.1

    The Nobium reserves the right to terminate its Services to you immediately upon any violation of these Terms, our Anti-Money Laundering (AML) framework, or any additional agreements that may exist between you and the Nobium. In such instances, the Nobium may cancel your Account and terminate your access to and use of the Services and the Nobium's website without prior notice and at its sole discretion.

  • 6.2

    The Nobium retains the right to conduct further investigations into any material breach by a Customer and to take appropriate actions. These actions may include, but are not limited to, freezing or blocking a transaction, suspending your Account, reporting suspected unlawful activities to law enforcement authorities or other relevant regulatory bodies, and disclosing any necessary information regarding the Customer's profile, email address, and other pertinent details.

  • 6.3

    If the Nobium determines that a Customer's use of the Services is not in compliance with applicable laws, our AML framework, and/or these Terms, or if such use poses a significant risk in terms of anti-money laundering, counter-terrorism financing, or other relevant considerations, the Nobium may refuse or discontinue providing Services to that Customer. This may also include: I. Freezing or blocking Transactions; II. Blocking the Account.

  • 6.4

    Customer's Account may also be blocked at the request of a competent authority.

  • 6.5

    The Nobium reserves the right to block a Customer's Account further upon request from a competent authority.

  • 6.6

    The Nobium retains discretion to block or cancel an Account, freeze or block a transaction, or terminate Services based on applicable law, these Terms, and our AML framework, proportionate to the severity of the Customer's breach and the associated risks.

  • 6.7

    The blockage of a Customer's Account may be lifted if the reasons for such action are resolved. Upon lifting the blockage, you will regain full control of your Account and may resume Transactions; however, the Nobium reserves the right to block your Account again in accordance with these Terms.

  • 6.8

    In cases of Account cancellation or blockage due to fraud investigations or violations of applicable law or these Terms, the Nobium retains full custody of any data and cryptocurrencies held in a Customer Wallet associated with the affected Customer. Such data and cryptocurrencies may be transferred to competent authorities upon their request, and it is the responsibility of those authorities to determine the disposition of such assets.

7. Consequences of Termination

You will retain access to your Nobium Account for ten (10) calendar days following the termination of Services, provided such access does not contravene applicable law or any court or governmental order. During this period, you will not be permitted to use the Services or your Account for any other purpose, and the Nobium may, at its sole discretion, limit the functionality or your access to the Services accordingly.

8. Term and Termination by the Customer

  • 8.1

    This Agreement between you and the Nobium shall remain in effect until the legal relationship between you and the Nobium has ended, meaning you are no longer a user of the Services and there are no outstanding claims.

  • 8.2

    You may terminate your use of the Services at any time. To do so, you may notify us via email at
    support@Nobium.com, effective immediately. We would appreciate any feedback regarding your reasons for termination, as it may help us improve our Services.

  • 8.3

    You agree to pay all fees and any expenses incurred for Services rendered prior to the termination of the Services.

  • 8.4

    You acknowledge that your Account will be canceled upon the effective termination of the Services, and you will not have further access to it except as specified in Section 7.

  • 8.5

    You understand that the termination of our Services does not entail the deletion of all your data by the Nobium, as we are legally obligated to retain such data in most circumstances. For further details on our data handling practices, please refer to our Privacy Policy .
